Double-Billing & Overbilling Traps

These protect the company when their billing system makes mistakes.

1. Error Rights Waiver

Look for: "Notify us within 30 days" or "Company records are conclusive."

FCBA gives 60 days by law. "Conclusive records" = no way to challenge their database.

2. No-Liability for Errors

Look for: "Not liable for duplicate charges."

10x duplicate $100 charges = they refund one, keep 9. Fee cap means $3 covers a $1,000 error.

3. Fee Rounding

Look for: "Rounded to nearest dollar."

"Standard" rounding usually rounds up: $9.51 → $10. Times 1M = $490K/year.

4. Hidden Surcharge

Look for: "Convenience fee may apply" without stating amount. Visa/MC caps surcharges at 3%.

5. Unilateral Price Change

Look for: "May change pricing at any time." NACA's #1 harmful term for consumers.

6. Asymmetric Error Fix

Look for: "Undercharge = bill. Overcharge = credit." Same clause, very different enforcement.

7. Passive Acceptance

Look for: "Continued use = acceptance." Silence is not consent.
