Financial Data & Subscription Rights Traps

1. Unlimited Billing Access

Look for: "Authorize charges for all amounts due." No per-transaction approval, no amount limit.

2. Token Without Revocation

Look for: "Store payment for future transactions." Token can charge after account deletion.

Protection: Remove payment method BEFORE cancelling. Monitor for 3 months.

3. Chargeback Penalty

Look for: "$25 dispute fee." Punishes FCBA rights. Likely unenforceable. Dispute anyway.

4. Arbitration + Class Waiver

Look for: "Binding arbitration. You waive class action." NACA's #1 worst term.

If there's an opt-out clause (§): send certified letter within 30 days.

5. Remote Forum Selection

Look for: "Governed by Delaware law. Exclusive venue in Delaware."

Check for a "consumer exception" allowing local suit.

6. Bad Billing Descriptor

35% of disputes are from unrecognized descriptors. Search online before subscribing: "what does [service] look like on my statement?"

7. Shortened Statute of Limitations

Look for: "Must file within 1 year." State gives 3-6. Systematic overbilling that takes 18 months to discover is unrecoverable.
