Tier classification - staircase with pricing tiers, invisible hand pushing, sole discretion

Tier Classification Discretion

What it looks like: "Your usage tier is determined at our sole discretion."

The Trap

  • The T&C doesn't define what usage corresponds to which tier. They can move you up (and raise your price) arbitrarily.
  • There's no appeal process because it's "sole discretion" — you have no recourse.
  • Even if thresholds exist, they can be changed at any time. A 1,000 API-call "basic" tier today could be a "premium" tier tomorrow.
  • Some services apply reclassification retroactively, billing higher rates for past usage.

Your Action Plan

  1. If you see "sole discretion" + "tier" → this is a trap.
  2. Look for defined thresholds: "Basic = 0-500 units." If no numbers, assume any usage can trigger upgrade.
  3. Before a usage spike, check your current tier's limits.
  4. Screenshot the pricing page at sign-up for reference.
